These Terms of Service ("Terms") govern your access to and use of the VPS hosting, virtual server, and related services (the "Services") provided by vpcshosting.com, operated by Levan Akhalaia, an individual sole trader based in Georgia ("we", "us", "our"). By ordering, accessing, or using the Services, you ("Client", "you") agree to be bound by these Terms.

1. The Services

We provide virtual private servers (VPS), virtual machines, and related infrastructure services on a subscription basis. Service specifications (CPU, RAM, storage, bandwidth) are as described on the order form at the time of purchase. We reserve the right to modify the underlying hardware, hypervisor, or network provider at our discretion, provided the agreed specifications are maintained or improved.

2. Account Registration

You must provide accurate, current, and complete information when registering for an account and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Acceptable Use Policy

You agree not to use the Services to:

  • Send unsolicited bulk email (spam) or engage in email/domain abuse;
  • Distribute malware, launch or participate in denial-of-service attacks, port scanning, or unauthorized intrusion attempts against third-party systems;
  • Host or distribute content that infringes intellectual property rights, or that is illegal under the law of Georgia or the law applicable to the underlying infrastructure provider;
  • Host phishing pages, botnet command-and-control infrastructure, or other fraud-related content;
  • Exceed fair-use resource limits in a way that degrades service for other clients (e.g. sustained 100% CPU/IO abuse on shared infrastructure).

We reserve the right to suspend or terminate, without refund, any Service used in violation of this Acceptable Use Policy, with or without prior notice depending on severity.

4. Payments and Billing

Fees are due in advance for the billing cycle selected at checkout. We accept the payment methods listed at checkout, including cryptocurrency via CoinGate. Failure to pay by the due date may result in suspension of the Service after a grace period, and termination and data deletion after continued non-payment as described in our billing reminders.

5. Refunds

Refunds are governed by our separate 30-Day Refund Policy, which forms part of these Terms by reference.

6. Service Availability and Backups

We work to maintain high availability of the Services but do not guarantee uninterrupted or error-free operation. Scheduled maintenance will be announced in advance where practical. You are solely responsible for maintaining your own backups of any data hosted on the Services. While we may take infrastructure-level snapshots for our own operational purposes, these are not a substitute for client-side backups, and we do not guarantee recovery of lost data.

7. Suspension and Termination

We may suspend or terminate your Service for non-payment, violation of these Terms or the Acceptable Use Policy, or if required by law or by an upstream provider. You may cancel your Service at any time from the client area or by contacting us; cancellation does not by itself entitle you to a refund except as set out in the Refund Policy.

8. Limitation of Liability

To the maximum extent permitted by law, the Services are provided "as is" without warranties of any kind. We shall not be liable for indirect, incidental, or consequential damages, including loss of data, revenue, or business, arising from your use of the Services. Our total liability for any claim shall not exceed the fees paid by you for the Service in the three (3) months preceding the claim.

9. Governing Law

These Terms are governed by the laws of Georgia, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Georgia.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the client area or by email. Continued use of the Services after a change takes effect constitutes acceptance of the revised Terms.
